Terms of Service for MTC Facility Solutions

These Terms of Service (“Terms”) govern your access to and use of services provided by MTC Facility Solutions (“MTC,” “we,” “us,” or “our”), including our website and any related communications or work orders. By using our services, you agree to these Terms.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
 
1) Services
We provide facility maintenance and related services for commercial and residential properties as agreed in quotes, work orders, or statements of work.
Scope, schedule, and pricing are defined in writing prior to service.
 
2) Estimates, Invoices, and Payments
Estimates are based on available information and may change if scope changes.
Invoices are due upon receipt unless otherwise stated. Late payments may incur fees or interest as permitted by law.
We may require deposits for materials or to secure scheduling.
Payments are processed via approved methods; third-party processors may apply their own terms.
 
3) Scheduling, Access, and Site Conditions
Client agrees to provide safe access to the property and disclose hazards, special requirements, or restrictions.
If conditions differ materially from what was disclosed or reasonably expected, we may adjust pricing/scope or reschedule.
 
4) Cancellations and Rescheduling
Please provide at least 24 hours’ notice to cancel or reschedule. Short-notice changes may incur a fee to cover costs.
 
5) Materials and Subcontractors
We may use subcontractors or vendors under our supervision.
Unless otherwise agreed, materials become the client’s property upon installation and payment.
 
6) Warranties and Service Guarantee
We warrant that our work will be performed in a professional and workmanlike manner consistent with industry standards.
If issues arise within a reasonable period after completion (e.g., 30 days), contact us for assessment and remedy.
This warranty excludes normal wear and tear, misuse, alterations by others, and conditions beyond our control.
 
7) Client Responsibilities
Provide timely information, approvals, and site access.
Ensure pets, valuables, and sensitive items are secured.
Comply with applicable permits, rules, or HOA requirements unless otherwise agreed.
 
8) Health, Safety, and Compliance
We follow applicable safety standards and reasonable precautions.
If unsafe conditions are identified, we may pause work until resolved.
 
9) Changes and Additional Work
Any change to scope, materials, or schedule must be approved in writing (email suffices). Additional work may result in revised pricing and timelines.
 
10) Limitation of Liability
To the fullest extent permitted by law:
MTC is not liable for indirect, incidental, special, or consequential damages.
Our total liability for any claim is limited to the amounts you paid for the specific service giving rise to the claim.
 
11) Insurance
We maintain industry-standard insurance coverage. Certificates available upon request.
 
12) Photos and Testimonials
With your permission, we may capture “before and after” photos solely for quality control, records, or marketing. You can withdraw consent at any time.
 
13) Privacy
Your use of our site and services is also governed by our Privacy Policy. See the “Privacy Policy” page for details.
 
14) Intellectual Property
All content we create for our marketing, website, and documentation remains our property unless otherwise agreed in writing.
Client-provided materials remain the client’s property; you represent you have rights to provide them.
 
15) Termination
Either party may terminate if the other materially breaches these Terms and fails to cure within a reasonable period after notice.
We may suspend or terminate services for nonpayment or unsafe conditions.
 
16) Dispute Resolution; Governing Law
These Terms are governed by the laws of the State of Texas.
Parties agree to attempt good-faith negotiation. If unresolved, disputes may be brought in the state or federal courts located in Texas.
 
17) Force Majeure
Neither party is liable for delays or failures due to causes beyond reasonable control (e.g., extreme weather, labor shortages, supply chain issues, power outages).
 
18) Entire Agreement; Changes
These Terms, together with any signed quotes or work orders, constitute the entire agreement regarding the services.
We may update these Terms periodically. Continued use of services after updates constitutes acceptance of the revised Terms.
